27-51-704.    Trucks carrying explosives or flammable liquids.
    (a)  The  operator of any truck carrying any explosive substances or flammable  liquids or gases as a cargo or part of a cargo shall, before crossing  any railroad tracks, stop the vehicle within fifty feet (50') but not  less than fifteen feet (15') from the nearest railroad and while stopped  shall open the door of the truck on the driver's side or roll down the  window at least twelve inches (12'') in order to remove any obstruction  of the sound of a train whistle. He shall also listen and look in both  directions along the track for any approaching train or signals  indicating the approach of a train and shall proceed to cross the tracks  only after he has determined that it is safe to do so.
(b)    (1)  Any operator of a truck who fails to comply with the provisions of this section shall be guilty of a misdemeanor.
      (2)    (A)    (i)  Upon  a first conviction, the operator shall be fined not less than one  hundred dollars ($100) nor more than three hundred dollars ($300); and
                  (ii)  In addition, the chauffeur's license of the operator shall be suspended for a period of thirty (30) days.
            (B)    (i)  For  a second offense, the operator shall be fined not less than one hundred  dollars ($100) nor more than three hundred dollars ($300); and
                  (ii)  In addition, that person's chauffeur's license shall be suspended for a period of one (1) year.
