SECTION 8740-8743




8740.  The Legislature finds and declares as follows:
   (a) That Latino Americans have made major contributions to the
social, cultural, and economic greatness of California.
   (b) That the California Museum of Latino History, Art, and
Culture, a nonprofit corporation, and the exhibits contained therein,
shall serve a statewide purpose by informing and educating the
public as to the contributions of Latino Americans and by enhancing
cultural understanding and appreciation.




8741.  The Board of Trustees for the California Museum of Latino
History, Art, and Culture shall, on or before January 1, 1991, and
annually thereafter, report to the Legislature on the status of the
museum project and the use of state funds appropriated and allocated
for the establishment of the museum, until the funds are fully
expended.



8742.  State moneys, from whichever fund appropriated, may be used
only for developing preliminary plans and working drawings,
construction, and initial equipment, including equipment for
exhibits. State financial assistance shall not exceed one-half of the
total cost of the project, exclusive of any costs of land
acquisition and the costs of the design, construction, and
installation of exhibits and the provision of interpretive services.



8743.  The state shall have no liability arising from the project
and its operation, and shall have no operational or maintenance
responsibility for the project. The grantee shall guarantee
performance in carrying out the project as "performance" is defined
by the Legislature and as represented to the granting state agency.
The grantee shall maintain adequate insurance to recover the state's
investment in the event of loss.
