43706.  (a) The state board shall petition the Federal Trade
Commission, pursuant to Part 455 of Title 16 of the Code of Federal
Regulations, for a limited exemption from the Federal Trade
Commission's Buyer's Guide, to allow this state to incorporate into
the Buyer's Guide utilized by motor vehicle dealers in this state, a
smog index chart pursuant to subdivision (b) of Section 44254.
   (b) Ninety days following approval by the Federal Trade Commission
of a petition pursuant to subdivision (a), it shall be unlawful for
any motor vehicle dealer licensed by the Department of Motor Vehicles
to display or offer for sale any used vehicle unless there is
affixed to the vehicle the Federal Trade Commission's Buyer's Guide
as required by Part 455 of Title 16 of the Code of Federal
Regulations which includes a smog index chart pursuant to subdivision
(b) of Section 44254. Ninety days following the final disapproval by
the Federal Trade Commission of a petition pursuant to subdivision
(a), it shall be unlawful for any motor vehicle dealer licensed by
the Department of Motor Vehicles to display or offer for sale any
used vehicle unless there is attached, by a perforated attachment, to
the Federal Trade Commission's Buyer's Guide as required by Part 455
of Title 16 of the Code of Federal Regulations, a smog index chart
pursuant to subdivision (b) of Section 44254.
   (c) Subdivisions (a) and (b) shall not apply to any vehicle sold
by either (1) a dismantler after being reported for dismantling
pursuant to Section 11520 of the Vehicle Code or (2) a salvage pool
after obtaining a salvage certificate pursuant to Section 11515 of
the Vehicle Code. Subdivisions (a) and (b) shall also not apply to
any vehicle sold to a dealer or sold for the purpose of being legally
wrecked or dismantled.



43707.  This article shall become inoperative five years from the
date determined pursuant to Section 32 of the act adding this
article, and on the January 1 following that date is repealed.
