Chapter 18. Retrocession of Property From the United States

Consent of state to retrocession of jurisdiction
Sec. 1. The consent of the state is given to the retrocession of
jurisdiction, either partially or wholly, by the United States over
property within Indiana over which the United States exercises
jurisdiction exclusively or concurrently with the state.

Acceptance by governor
Sec. 2. The governor is authorized to accept for the state the
retrocession of jurisdiction if the governor considers retrocession to
be in the best interest of the state.

Perfection
Sec. 3. Retrocession of jurisdiction under this chapter must be
perfected as follows:
(1) An agent of the United States authorized to dispose of
property must give written notice of the retrocession to the
governor.
(2) The governor must accept the retrocession on behalf of the
state on the written notice.
(3) The notice, with the governor's acceptance, must be:
(A) recorded in the office of the recorder of the county
where the property is located; and
(B) filed in the land office.
