455B.277 - FLOOD CONTROL WORKS COORDINATED.

        455B.277  FLOOD CONTROL WORKS COORDINATED.         All flood control works in the state, which are established and      constructed after April 16, 1949, shall be coordinated in design,      construction, and operation according to sound and accepted      engineering practice so as to effect the best flood control      obtainable throughout the state.  A person shall not construct or      install works of any nature for flood control until the proposed      works and the plans and specifications for the works are approved by      the department.  The department shall consider all the pertinent      facts relating to the proposed works which will affect flood control      and water resources in the state and shall determine whether the      proposed works in the plans and specifications will be in aid of and      acceptable as part of, or will adversely affect and interfere with      flood control in the state, adversely affect the control,      development, protection, allocation, or utilization of the water      resources of the state, or adversely affect or interfere with an      approved local water resources plan.  In the event of disapproval,      the department shall set forth the objectionable features so that the      proposed works and the plans and specifications for the proposed      works may be corrected or adjusted to obtain approval.         This section applies to drainage districts, soil and water      conservation districts, the natural resource commission, political      subdivisions of the state, and private persons undertaking projects      relating to flood control.
