Article 26.--RETIREMENT SYSTEM FOR JUSTICES AND JUDGES

      20-2601a.   Abolition of Kansas judges retirementboard; transfer ofpowers, duties and functions to board of trustees of Kansas publicemployees retirement system; preservation of decisions, determinations andrules and regulations; adoption of new rules and regulations.(a) On and after July 1, 1975, the Kansas judges retirement boardestablished pursuant to K.S.A. 20-2604 and amendments thereto shall be andis hereby abolished,and on such date, except as otherwise provided in this act, all ofthepowers, duties and functions of said Kansas judges retirement board,whether in its capacity as that board pursuant to K.S.A. 20-2604 andamendments thereto or in itscapacity as the Kansas official court reporters retirement board pursuantto K.S.A. 20-2704, shall be and are herebytransferred to and conferred andimposed upon the board of trustees of the Kansas public employeesretirement system.

      (b)   Except as otherwise provided in this act, the board of trustees ofthe Kansas public employees retirement system shall be the successor inevery way to the powers, duties and functions of the Kansas judgesretirement board, whether in its capacity as that board pursuant to K.S.A.20-2604 and amendments thereto or in its capacity as the Kansas officialcourt reportersretirement board pursuant to K.S.A. 20-2704, inwhich the same were vestedprior to July 1, 1975. Every act performed in the exercise of such powers,duties and functions by or under the authority of the board of trustees ofthe Kansas public employees retirement system shall be deemed to have thesame force and effect as if performed by the Kansas judges retirement boardin which such powers, duties and functions were vested prior to July 1,1975.

      (c)   On and after July 1, 1975, whenever the Kansas judges retirementboard, or words of like effect, is referred to or designated by a statuteor contract or other document, such reference or designation shall bedeemed to apply to the board of trustees of the Kansas public employeesretirement system.

      (d)   On and after July 1, 1975, whenever the Kansas official courtreporters retirement board, or words of like effect, is referred to ordesignated by a statute or contract or other document, such reference ordesignation shall be deemed to apply to the board of trustees of the Kansaspublic employees retirement system.

      (e)   The board of trustees of the Kansas public employees retirement systemshall adopt rules and regulations necessary for the administration of theretirement system for judges and for the transaction of business consistentwith law. All rules or regulations of the Kansas judges retirement board inexistence on July 1, 1975, whether adopted when acting as that boardpursuant to K.S.A. 20-2604 and amendments thereto or when acting as theKansas official courtreporters retirement board pursuant to K.S.A. 20-2704, shall continue inforce and effect and shall be deemed to be duly adopted rules orregulations of the board of trustees of the Kansas public employeesretirement system, until revised, amended, revoked or nullified pursuant tolaw.

      (f)   All decisions and determinations of the Kansas judges retirementboard in effect on July 1, 1975, whether made when acting as that boardpursuant to K.S.A. 20-2604 and amendments thereto or when acting as theKansas official courtreporters retirement board pursuant to K.S.A. 20-2704, shall continue inforce and effect and shall be deemed to be decisions and determinations ofthe board of trustees of the Kansas public employees retirement system,until revised, amended, revoked or nullified pursuant to law.
