      21-3448.   Battery against a mental healthemployee.(a) Battery against a mental health employee is abattery,as defined in K.S.A. 21-3412, and amendments thereto, committed against amentalhealth employee by a person in the custody of the secretary of social andrehabilitation services, while such employee is engaged in the performance ofsuch employee's duty.

      (b)   Battery against a mental health employee is a severity level 7, personfelony.

      (c)   As used in this section "mental health employee" means an employee ofthe department of social and rehabilitation services working at Larned statehospital, Osawatomie statehospital and Rainbow mental health facility, Kansas neurological institute andParsons state hospital and training center and the treatment staff asdefined in K.S.A. 59-29a02, andamendments thereto.

      (d)   This section shall be part of and supplemental to the Kansas criminalcode.
