Article 45.--AID TO INDIGENT DEFENDANTS

      22-4527.   Abolition of board of supervisors of panelsto aid indigent defendants; transfer of officers and employees,rules and regulations, directives and standards, and records andproperty to new board; existing defense services systemscontinued subject to change.(a) The board of supervisors of panels to aid indigent defendants createdby K.S.A. 22-4514 is hereby abolished.

      (b)   On the effective date of this act, all officers and employees whowere engaged immediately preceding the effective date of this act in theperformance of powers, duties and functions of the board of supervisorsof panels to aid indigent defendants or public defenders and who, in theopinion of the state board of indigents' defense services, are necessaryto perform the powers, duties and functions of the state board of indigents'defense services under this act, may become officers andemployees of the state board of indigents' defense services. Any such officeror employee shall retain all retirement benefits and all rights which hadaccrued to or vested in such officer or employee in the unclassified serviceunder the Kansas civil service act immediately preceding the effective dateof this act, and the service of each such officer and employee shall bedeemed to have been continuous. All transfers and any abolishment of positionsof personnel shall be in accordance with law and applicable rules and regulations.

      (c)   All rules and regulations, orders, directives and standards of theboard of supervisors of panels to aid indigent defendants or of the supremecourt relating to powers, duties and functions transferred to or imposedupon the state board of indigents' defense services, which rules and regulations,orders, directives and standards were in existence immediately precedingthe effective date of this act, shall continue to be effective and shallbe deemed to be the rules and regulations, orders, directives and standardsof the state boardof indigents' defense services until amended, revokedor nullified pursuant to law.

      (d)   The system providing legal defense services for indigent persons whichis in existence and effect in each county and judicial district immediatelypreceding the effective date of this act shall continue in existence andeffect subject to change by the state board of indigents' defense servicesin accordance with this act.

      (e)   On and after the effective date of this act, all books, records andother property which relate to providing legal defense services for indigentpersons and belonging to the supreme court, the board of supervisors ofpanels to aid indigent defendants or offices of public defenders immediatelypreceding the effective date ofthis act shall become the property of the state board of indigents' defense services.

      (f)   Whenever the board of supervisors of panels to aid indigent defendantsis mentioned by statute, contract or other document, the reference shallbe deemed to apply to the state board of indigents' defense services.
