      25-206.   Fees of candidates; declaration.(a) Except as provided in subsection (b), when a candidate in lieu ofnomination petitions files a declaration ofintention to become acandidate for any national, state, county or township office, theaccompanying fee shall be in an amount as follows: For the office ofUnited States senator, United States representativefrom any district or at large, allstate offices, and all county offices, where the salary is over $1,000per year, a sum equal to 1% of one year's salary as determined by thesecretary of state for stateand national offices, and as determined by the county election officerfor county offices. For all county offices where the salary is $1,000or less, a fee of $5; for astate senator, $75; for representatives, $50; for all township offices,$1. Nothing inthis act shall be construed as requiring any fee of a candidate filing adeclaration of intention to become a candidate for precinct committeeman orprecinct committeewoman. Theofficer receiving the funds shall turn them over tothe state treasurer, if depositedwith the secretary of state, or to the county treasurer, if deposited withthe county election officer, and the funds shall become a part of thegeneral fund of the respective government.

      Such declaration shall beprescribed by the secretary of state andshall be attested before a county election officer or deputy countyelection officer in the case of county and township offices, and beforea county election officer, the secretary of state or a deputy of one ofsuch officers in the case of state and national offices, and a notarypublic in the case of precinct committeemen and committeewomen.

      (b)   When a candidate for the office ofdistrict magistrate judge, in lieu of nomination petitions, files adeclaration of intention to become a candidate for such office, thedeclaration shall be in the same form and subject to the same method ofattestation as provided for other state officers in subsection (a) andthe required fee to accompany the declaration shall be $100.
