Article 41.--ELECTION CAMPAIGN FINANCE; GENERAL

      25-4172.   Statements or reports by certain out-of-state individuals andpersons; contents; filing; maintenance of records.(a) Except as provided by subsection (b), any combination ofthree or more individuals or a person other than an individual,notdomiciled in this state,which makes or intends to make a contributionor contributions to a candidate, candidate committee, party committee orpolitical committee in this state shall either:

      (1)   Prepare a verified statement containing: (A) The names andaddresses of the responsible individuals; (B) the name and address ofeach person who has made one or more contributions to such out-of-statecombination of individuals or person other than an individual in anaggregate amount in excess of $50 within the preceding12 months, together with the amount and date of suchcontributions; and (C) the aggregate amount of all other contributionsto such out-of-state combination of individuals or person other than anindividual within the preceding 12 months. Such statement shallbefiled in the office of the secretaryof state at the times prescribed forthe filing of reports of treasurersby K.S.A. 25-4148, and amendments thereto; or

      (2)   file a statement of organization as provided by K.S.A. 25-4145,and amendments thereto, establisha separate fund for the purpose of receivingcontributions and making expenditures relating to any election for stateoffice in this state and file statements and reports involving such fundin the manner provided by K.S.A. 25-4148, and amendments thereto, for politicalcommittees and party committees. Any transfer from another fund to theseparate fund herein provided for shall be subject to the requirementsof provision (1).

      (b)   The provisions of subsection (a) shall not apply to: (1) Anypolitical party having a national organization which reports underfederal law; (2) a bona fide corporationorganized under the laws of another state; or (3) a union, if thecontribution is made from union funds.

      (c)   Each combination of individuals or person other than anindividual which is subject to this section shall maintain, in its ownrecords, the name and address of any person who has made one or morecontributions to such combination of individuals or person other than anindividual, together with the amount and date of such contributions,regardless of whether such information is required to be reported.
