Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 10.--ENFORCEMENT

      32-1004.   Unlawful possession of wildlife or wildturkey; refusal to allow inspection of property used in taking wildlife;penalties.(a) It is unlawful for any person to:

      (1)   Possess a carcass of a big game animal, takenwithin this state, unlessa carcass tag, issued by the secretary, isattached to it in accordance with rules and regulations adopted by thesecretary;

      (2)   possess a carcass of a wild turkey, taken in this state, unless acarcass tag, if required and issued by the secretary, is attached to it, inaccordance with rules and regulations adopted by the secretary;

      (3)   possess a carcass of a big game animal or wild turkey, taken within thestate, unless a check station tag, if required and issued by the secretary, isattached to it, in accordance with rules and regulations adopted by thesecretary;

      (4)   possess any wildlife unlawfully killed or otherwise unlawfully takenoutside this state;

      (5)   cause to be shipped within, from or into this state anyillegally taken or possessed wildlife;

      (6)   intentionally import into this state, or possess orrelease in this state, any species of wildlife prohibited pursuant to K.S.A.32-956and amendments thereto;

      (7)   refuse to allow any conservation officer or deputyconservation officer or any law enforcement officer to inspect and count anywildlife in such person's possession; or

      (8)   refuse to allow any conservation officer or deputyconservation officer or any law enforcement officer to inspect any devices orfacilities of such person which are used in taking, possessing, transporting,storing or processing anywildlife subject to the wildlife and parks laws of this state or rules andregulations of the secretary.

      (b)   The provisions of subsection (a)(1), (a)(2) and (a)(3) do notapply to animals sold in surplus property disposal sales of departmentexhibit herds or animals legally taken outside this state.

      (c)   Any person convicted of violating provisions of this section shall besubject to the penalties prescribed in K.S.A. 32-1031, and amendments thereto,except as provided in K.S.A. 32-1032, and amendments thereto, relating to biggame and wild turkey.
