Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 10.--ENFORCEMENT

      32-1047.   Seizure of wildlife, devices, equipment andfirearms; disposition.The department is hereby empowered anddirected to seize andpossess any wildlife which is taken,possessed, sold or transported unlawfully, and any steel trap, snare orother device or equipment used in taking ortransporting wildlife unlawfully or during closed season. The department ishereby authorized and directed to:

      (a)   Sell the seized item, including wildlife parts with a dollarvalue,and remit the proceeds to the state treasurerinaccordance with the provisions of K.S.A. 75-4215, and amendments thereto. Ifthe seized item is a firearm that has been forfeited pursuant to K.S.A.21-4206, and amendments thereto, then it may be sold unless: (1) The firearm issignificantly altered in any manner; or (2) the sale and public possession ofsuchfirearm is otherwise prohibited by law. Uponreceipt of each such remittance, the state treasurer shalldeposit the entire amount in the state treasury to thecredit of the wildlife fee fund; or

      (b)   retain the seized item for educational, scientific ordepartment operational purposes.
