Article 11.--BOATING AND WATER ACTIVITIES

      32-1149.   Regattas and other water events.(a) The secretary may authorize the holding of regattas, motorboat orother boat races, marine parades, tournaments or exhibitions on anywaters of this state. The secretary shalladopt, in accordance with K.S.A. 32-805 and amendments thereto,rules and regulations necessary to implement this section, including butnot limited to: (1) Provisions addressing the safety of all vessels,participants and the public; (2) permit requirements and permit applicationprocedures, including the providing of such information as the secretaryrequires; and (3) establishment of conditions under which the event shallbe conducted. The application for a permit to hold such regatta,motorboat or other boat race, marine parade, tournament or exhibitionshall be accompanied by the water event permit fee prescribed pursuantto K.S.A. 32-1172. The secretary, upon receipt of a properapplication and the prescribed permit fee may issue a permit if it isdetermined that the event is in the public interest, the area requested forholding the event has sufficient accommodations and facilities for the eventand the event is compatible with other uses of the area requested for theevent. No such event shall be conducted without the prior authorization of thesecretary in writing.

      (b)   The provisions of this section shall not exempt any person fromcompliance with applicable federal law or regulation.
