Chapter 32.--WILDLIFE, PARKS AND RECREATION
Article 8.--DEPARTMENT OF WILDLIFE AND PARKS

      32-805.   Wildlife and parks commission; membership;powers and duties; compensation and expenses; meetings, quorum.(a) There is hereby created within and as a part of the department the Kansaswildlife and parks commission which shall be composed of seven members.The governor shall appoint residents of this state to be membersof the commission. One member of the commission shall be chosen from eachfish and wildlife administration region as established by the department.In the appointment of members of the commission, the governor shall giveconsideration to the appointment of licensed hunters, fishermen andfurharvesters, park users and to nonconsumptive users ofwildlife and park resources. No more than a majority of themembers shallbe of the same political party. Eachmember of the commission shall hold office for a term of four years and until asuccessor is appointed and qualified, except that in appointing the originalcommission members, the governor shall designate one member for a term endingJuly 1, 1988, one member for a term ending July 1, 1989, and two members forterms ending July 1, 1990.The governor shallfill any vacancy on the commission prior to the expiration of a term byappointment for the unexpired term.

      (b)   Each member of the commission shall take and subscribe an oath oraffirmation as required by law before taking office.

      (c)   The governor may remove a commissioner after opportunity for ahearing in accordance with the provisions of the Kansas administrativeprocedure act. If the commissioner is removed, the governor shall file in theoffice of the secretary of state a complete statement of all charges madeagainst such commissioner and the governor's findings thereon, together with acomplete record of the proceedings.

      (d)   The commission shall have such powers, duties and functions as prescribedby law. Other than rules and regulations pertaining to personnel matters ofthe department, the secretary shall submit to the commission all proposed rulesand regulations. The commission shall either approve, modify and approve, orreject such proposed rules and regulations. The secretary shall adopt suchrules and regulations so approved or so modified and approved. Fees establishedfor licenses, permits, stamps and other issues of the department shall besubject to the approval of the commission. It also shall be the duty of thecommission to serve in an advisory capacity to the governor and the secretaryin the formulation of policies and plans relating to the department.

      (e)   The governor shall designate one commission member to serve aschairperson of the commission. Members of the commission attending meetings ofthe commission, or attending a subcommittee meeting thereof authorized by thecommission, shall be paid compensation, subsistence allowances, mileage andother expenses as provided in K.S.A. 75-3223 and amendments thereto.A majority of the members of the commission shall constitutea quorum for the transaction of business. Meetings may be called by thechairperson and shall be called on the request of a majority of the members ofthe commission.
