Article 9.--LICENSES, PERMITS, STAMPS AND OTHER ISSUES

      32-933.   Physical or visual disability, assistancepermit.(a) Any person having a permanent physical or visual disability such that theperson cannot safely hunt or fish in accordance with law and rules andregulations of the department, as certified by a person licensed to practicethe healing arts in any state or a person licensed to practice optometry in anystate, shall be eligible to obtain a disability assistance permit. The permitshall allow the permitholder to designate another person to take, on behalf ofand while accompanied by the permitholder, the permitholder's legal limit ofgame or fish. The person designated bythe permitholder shall not be required to hold any licenses, permits,stamps or any other issues of the department otherwise required for theactivity being engaged in but shall remainsubject to all other laws and rules and regulations of the department for theactivity being engaged in.The permitholder shall accompany into the field and be in close proximity tothe person designated by the permitholder. The person designated by thepermitholder shall not be a person whose fishing, hunting or furharvestinglicenseis currently suspended, restricted or revoked.On the determination ofthe secretary, the disability assistance permit may designate the hunting orfishing activity for which assistance to the permitholder may be provided.

      (b)   The secretary shall adopt, in accordance with K.S.A. 32-805, andamendments thereto, rules and regulations providing for the approval ofapplicants for permits pursuant to subsection (a) and for the issuanceof such permits.

      (c)   Falsely obtaining or using a permit authorized by this section is aclass C misdemeanor.
