Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 7.--SOCIAL WELFARE

      39-757.   Secretary to deposit moneys received under39-709 and 39-756 with state treasurer; dispositions; expenditure fromfunds.(a) The secretary of social and rehabilitation services shall remit allmoneys received by or for the secretary from the enforcement of rightsassigned to the secretary under subsection (b) of K.S.A. 39-709, andamendments thereto, to the statetreasurer in accordance with the provisions ofK.S.A. 75-4215, and amendments thereto. Upon receipt of each suchremittance, the state treasurer shall deposit the entire amountin the state treasury as follows: (1) Amounts to be distributed pursuantto part D of title IV of the federal social security act (42 U.S.C. §651 et seq.), or acts amendatory thereof or supplemental thereto,to the state shall be credited to the title IV-D aid to families withdependent children fee fund, and all expenditures from such fund shallbe made in accordance with appropriation acts upon warrants of thedirector of accounts and reports issued pursuant to vouchers approved bythe secretary or by a person or persons designated by the secretary; and(2) amounts to be distributed pursuant to part D of title IV of thefederal social security act (42 U.S.C. § 651 et seq.), oractsamendatory thereof or supplemental thereto, to applicants for orrecipients of aid under subsection (b) of K.S.A. 39-709,and amendments thereto,shall be credited to the title IV-D aid to families with dependentchildren claims fund, and all expenditures from such fund shall be madeupon warrants of the director of accounts and reports issued pursuant tovouchers approved by the secretary or by a person or persons designatedby the secretary.

      (b)   The secretary of social and rehabilitation services shall remitall moneys received by or for the secretary under K.S.A. 39-756, andamendments thereto, to the statetreasurer in accordance with the provisions ofK.S.A. 75-4215, and amendments thereto. Upon receipt of each suchremittance, the state treasurer shall deposit the entire amountin the state treasury as follows: (1) Amounts to be distributed pursuantto part D of title IV of the federal social security act (42 U.S.C. §651 et seq.), or acts amendatory thereof or supplemental thereto,to the state shall be credited to the title IV-D fee fund, and allexpenditures from such fund shall be made in accordance with appropriateacts upon warrants of the director of accounts and reports issuedpursuant to vouchers approved by the secretary or by a person or personsdesignated by the secretary; and (2) amounts to be distributed pursuantto part D of title IV of the federal social security act (42 U.S.C. §651 et seq.), or acts amendatory thereof or supplemental thereto,to persons who under K.S.A. 39-756, and amendments thereto, are eligiblefor servicesspecified in such section shall be credited to the title IV-D claimsfund, and all expenditures from such fund shall be made upon warrants ofthe director of accounts and reports issued pursuant to vouchersapproved by the secretary or by a person or persons designated by thesecretary.

      (c)   Money shall be deposited in the funds established by subsections(a) and (b) of this section and shall be distributed from such funds inaccordance with the provisions of part D of title IV of the federalsocial security act (42 U.S.C. § 651 et seq.), or actsamendatorythereof or supplemental thereto.
