      39-782.   Hearing required prior to certifying adult care home forparticipation in state medical assistance program as intermediate carefacility for mental health; notice.Prior to certifying an adult care home for participation inthe state medical assistance program as an intermediate care facility formental health, the secretary of social and rehabilitation services shallhold a public hearing in the area in which the facility is located.At least 10 days prior to the hearing, the secretary of social andrehabilitation services shall give notice in a newspaper of generalcirculation in the area in which the facility is located that the facilityhas applied for certification for participation in the state medicalassistance program as an intermediate care facility for mental health andthat a public hearing is to be held to obtain public comment in regard tosuch application. In addition, the notice shall state the time and placeof the public hearing and the manner in which interested parties maypresent their views at the hearing. The secretary of social andrehabilitation services shall consider the public comments at the hearingin determining whether to grant such certification.
