39-952. Correction order not issued, when.The secretary of aging or the secretary'sdesignee shall not issue a correction order to a person licensed to operatean adult care home because of a violation of a provision of article 9 ofchapter 39 of the Kansas Statutes Annotated or a rule and regulation adoptedthereunder which was caused by any person licensed by the state board ofhealing arts to practice a branch of the healing arts if such person licensedby the state board of healing arts is not an owner, operator or employee of theadult care home and if the person licensed to operate the adult care home showsthat such person has exercised reasonable diligence in notifying the personlicensed by the state board of healing arts to practice a branch of the healingarts of such person's duty to the residents of the adult care home.
