Article 16.--RECIPROCAL OR INTERINSURANCE CONTRACTS

      40-1607.   Service of process upon commissioner; fee;suits by andagainst subscribers.Concurrently with the filing of the declaration provided for by theterms of K.S.A. 40-1603 andamendments thereto, the attorney-in-fact shall file withthe commissioner of insurance an instrument in writing, executed bysuch attorney-in-fact for the reciprocalconditioned that upon the issuance of the certificate of authorityprovided for in K.S.A. 40-1610, and amendments thereto, serviceof process may be had upon the commissioner in all suits inthis state arising out of such policies, contracts or agreements, whichservice shall be valid and binding upon the reciprocal. Such service ofprocess shall be executed in accordance with the provisions of K.S.A. 40-218and amendments thereto. Any reciprocal operating under the laws of thisstate may sue or be sued in the declared name of thereciprocal.
