      40-2220.   Coverage of loss from pre-existing conditions required, when.Notwithstanding the provisions of K.S.A. 40-2203 (A) (2) (b), if an insureror a non-profit hospital, medical, or dental service corporation electsto use a simplified application form, with or without a question as to theapplicant's health at the time of application, but without any questionsconcerning the insured's health history or medical treatment history, thepolicy must cover any loss occurring after twelve (12) months from any pre-existingcondition not specifically excluded from coverage by terms of the policy,and, except as so provided, the policy or contract shall not include wordingthat would permit a defense based upon pre-existing conditions.
