Chapter 40.--INSURANCE
Article 24.--REGULATION OF CERTAIN TRADE PRACTICES

      40-2441.   Same; definitions.As used in K.S.A. 40-2440 through 40-2442 and amendments thereto:

      (a)   The term "clean claim" means a claim that has no defect or impropriety,including any lack of required substantiating documentation, or particularcircumstance requiringspecial treatment that prevents timely payment from being made on the claimunder the Kansas health care prompt payment act.

      (b)   The term "claim" means a written proof of loss as defined in paragraph(7) of subsection (A) of K.S.A. 40-2203, and amendments thereto, or anelectronic proof of loss which contains the information required by paragraph(7) of subsection (A) of K.S.A. 40-2203, and amendments thereto.

      (c)   The term "policy of accident and sickness insurance" means any policy orcontract insuring against loss resulting from sickness or bodily injury ordeath by accident, or both, any hospital, dental or medical expensepolicy, health, hospital, medical service corporation contract issuedby a stock or mutual company or association, a health maintenance organizationor any otherinsurer, third party administrator or other entity which pays claims pursuantto a policy ofaccident and sickness insurance. The term policy of accident and sicknessinsurance does notinclude any policy or contract of reinsurance, life insurance, endowment orannuity contract,policies or certificates covering only credit, disability income, long-termcare, medicaresupplement, drug, or vision-care only policy, coverage issued asa supplement to liabilityinsurance, insurance arising out of a workers compensation or similar law,automobilemedical-payment insurance or insurance under which benefits are payable withoutregard to faultand which is statutorily required to be contained in any liability insurancepolicy or equivalentself-insurance.
