      40-3308.   Confidentiality of information and documents disclosed toor filed with commissioner.All information, documents and copies thereof obtained by or disclosedto the commissioner of insurance or any other person in the course of anexamination or investigation made pursuant to K.S.A. 40-3307 andamendments thereto andall information reported pursuant to K.S.A. 40-3305 and amendmentsthereto, shall be givenconfidential treatment and shall not be subject to subpoena. Suchinformation, documents and copies thereto shallnot be made public by the commissioner of insurance, the national associationof insurance commissioners or any other person,except to insurance departments of other states and as otherwise providedin this section, without the priorwritten consent of the insurer to which it pertains. If thecommissioner of insurance, after giving the insurer and its affiliateswho would be affected thereby, notice and opportunity to be heard inaccordance with the provisions of the Kansas administrative procedure act,determines that the interests of policyholders, shareholders or thepublic will be served by the publication thereof,the commissioner maypublish all or any part thereof in such a manner as the commissioner may deemappropriate.
