Article 55.--PUBLIC ADJUSTERS LICENSING ACT

      40-5506.   Examination; retaking examination;when.(a) An applicant for a public adjuster license under thisactshallpass a writtenexamination, unless exempt from this requirement pursuant to K.S.A. 2009 Supp.40-5507, andamendmentsthereto. The examination shall test the knowledge of the individual concerningthe duties andresponsibilities of a public adjuster and the insurance laws and regulations ofthis state.Examinations required by this section shall be developed and conducted underrules andregulations prescribed by the commissioner.

      (b)   The commissioner may make arrangements, including contracting with anoutsidetesting service, for administering examinations.

      (c)   An applicant who fails to appear for the examination as scheduled orfails to pass theexamination may retake the examination following a waiting period of not lessthan seven daysfollowing the date of the first examination. If the applicant again fails tosatisfactorily completethe examination, the applicant may retake the examination following a waitingperiod of not lessthan seven days following the date of the second examination. If the applicantagain fails tosatisfactorily complete the examination, the applicant may retake theexamination following awaiting period of not less than six months following the date of the thirdexamination, exceptthat following a waiting period of not less than two years following the dateof the thirdexamination, the applicant will be treated as a new applicant and newexamination and waitingperiods shall apply.
