42-390. Same; penalty for excessive charges.Every person, association or corporation owning or controlling, orclaiming to own or control any ditch, canal or reservoir as is mentionedin K.S.A. 42-389 or any officer or agent ofsuch association or corporation, who shall, after demand in writing madeupon him for the supply or delivery of water for irrigation,manufacturing, milling or domestic purposes, to be delivered from theditch, canal or reservoir owned, possessed, or controlled by him, andafter tender of the lawful rates of compensation therefor in lawfulmoney, demand, require, bargain for, accept or retain from the partymaking such application any money or other thing of value, or anypromise or contract or any valuable consideration whatever, as suchroyalty, bonus, premium, prerequisite or condition precedent, as is bythe provisions of the preceding section prohibited, shall be deemedguilty of a misdemeanor, and on conviction thereof shall be punished bya fine of not less than one hundred dollars nor more than five thousanddollars, or imprisonment for a term of not less than three months normore than one year, or both such fine and imprisonment, in thediscretion of the court.
