Chapter 42.--IRRIGATION
Article 3.--IRRIGATION AND IRRIGATION DISTRICTS

      42-392.   Superintendent of ditch or works; service of process upon;certification of name to district court; vacancies.The proprietors of every ditch, conduit, reservoir or other works forthe diversion, carrying or storage of water for irrigation, now inexistence, shall within thirty days after the approval of this act, and theproprietors of every such works hereafter formed shall, immediately uponthe commencement of the construction of such works, cause to be chosen asuperintendent of such ditch, conduit or other works, upon whom may beserved processes in actions wherein may be brought in question the right ofsuch ditch, conduit, reservoir or other works to the waters appropriated,carried or stored by means thereof, and all notices required by this act tobe served upon the proprietors of such works in any proceedings for theadjudication of the rights and priorities to the use of water among theseveral appropriators, and all notices touching the administration of suchworks.

      They shall forthwith cause the name and address of such superintendentto be certified in writing to the clerk of the district court in and foreach county in which such works or any part thereof shall be situated. Incase of the death, resignation or removal of any such superintendent fromhis office, the proprietors of every such works shall forthwith choose someother person in his stead, and certify his name and address in like manneras herein above provided.
