Article 3.--IRRIGATION AND IRRIGATION DISTRICTS

      42-398.   Entry upon premises by officers.Any water bailiff, the county commissioners, road overseers and cityofficers, within their respective counties, districts, cities and towns,upon complaint of any person concerning any artesian well, that the personcontrolling the same is wont to suffer the waters thereof to unnecessarilyrun to waste therefrom, or has in any respect violated this act, may at anyreasonable hour of the day or night enter upon any premises where such wellis situated, for inspecting the same, and for ascertaining whether there issufficient cause for such complaint, and in order to institute or cause tobe instituted criminal prosecutions for any violation of this act. Andevery person sinking or boring for an artesian well upon his own land, orsuffering others so to do, shall be deemed in law to expressly license suchentry of the officers aforenamed, or any of them, for the purpose of suchinspection and examination.
