Chapter 42.--IRRIGATION
Article 7.--DISTRICTS

      42-707.   Officers of board; rules and bylaws; central office; seal;contracts; records; open to inspection; duties of county treasurer andtreasurer of district.That as soon as practicable after they have qualified, the directorsshall meet and select from their number a president, secretary andtreasurer, and shall designate one of their number to act as vice-presidentin case the regular president is absent; that said board of directors mayformulate and adopt rules and bylaws to regulate the transaction ofbusiness, which may be amended and changed at their pleasure. The board ofdirectors may establish a central office for a meeting place and for theconduct of the affairs and business of the district, which office may belocated outside the corporate boundaries of the district, if such locationis more convenient than a location within the district. The board ofdirectors shall adopt a seal with which all contracts executed by the boardshall be authenticated. The president shall preside at all meetings of theboard when he is present, and shall execute all contracts in the corporatename of the district, and all such contracts shall be attested by thesecretary, and the seal of the district affixed thereto.

      All of the transactions and proceedings of the board shall be entered inwriting by the secretary in a journal to be kept by him expressly for suchpurpose, which journal shall at all times be open for inspection by allelectors of the district, and by the chief engineer and his subordinatesand representatives, and the same or copies thereof, duly authenticated bythe secretary under seal of the corporation, shall be admitted in allcourts as evidence of such proceedings and transactions. The countytreasurer of the county in which the registered office of said irrigationdistrict is located shall receive, safely keep and pay out as hereinafterprovided all funds belonging to the district, and shall be liable upon hisofficial bond for such funds and for any default in the proper performanceof his duty in that respect, provided that county treasurers makingcollections of assessments and taxes upon lands within said districts andwithin their respective counties shall transmit and transfer said moneys tothe county treasurer, wherein the registered office of said district islocated, and that each said county treasurer shall be liable upon hisofficial bond for such funds and for the proper performance of his duty inthat respect. The purchase price of bonds sold by the district shall bepaid directly to such county treasurer, of county where registered officeof district is located. The county treasurer of the county in which theregistered office of an irrigation district is located shall pay to thetreasurer of such district all moneys in the county treasury belonging tosaid district, upon the order of the treasurer of the districtcountersigned by the president and the secretary of the district except asotherwise provided by law: Provided, That said county treasurer shallnot pay to said district treasurer any such moneys unless and until he hasbeen notified by the secretary of state that said district treasurer hasfiled his bond and the same has been approved by the secretary of state.

      All moneys received by the treasurer of the district from the countytreasurer shall be deposited by him in a depository designated by the boardof directors as provided in article 14 of chapter 9 of the General Statutesof 1949, and acts amendatory thereof. The treasurer of each irrigationdistrict shall pay out, on the warrant of the secretary, signed by thepresident of the district moneys which shall come into his hands for theuse of the district, and he shall not pay any sum or sums from the funds ofthe district in any other manner. The treasurer shall keep a book in whichhe shall enter all the moneys received and disbursed by him, specifying theperson or persons to whom, and the object for which, the same has been paidout. On the first Monday of February of each year, he shall present to theboard of directors at its regular meeting a report in writing containing astatement of all moneys received by him from the county treasurer or fromany other source during the calendar year preceding; and of thedisbursements made by him with the items of such disbursements, and exhibitthe warrants or checks, which report shall be recorded by the secretary;and at the close of his term of office shall settle with the board ofdirectors of the district, and shall hand over to his successor said bookand all other records and papers coming into his hands as treasurer of thedistrict, together with all the moneys remaining in his hands as suchtreasurer.
