44-1120. Applicability, construction and effective date of 1988 act.(a) This act and the amendments made by this act shalltake effect on the effective date of this act, except that, with respect toany employee whois subject to a collective bargaining agreement, such amendments shall notapply until the termination of such collective bargaining agreement orJanuary 1, 1990, whichever occurs first, if such collective bargaining agreement:
(1) Is in effect prior to the effective date of this act;
(2) terminates on or after the effective date of this act;
(3) has any provision which was entered into by a labor organization (asdefined by section 6(d)(4) of the Fair Labor Standards Act of 1938 (29U.S.C. 206(d)(4)); and
(4) contains any provision that would be superseded by such amendments,but for the operation of this section.
(b) This section shall be a part of and supplemental to the Kansas agediscrimination in employment act.
