Chapter 44.--LABOR AND INDUSTRIES
Article 6.--REGULATION OF LABOR AND INDUSTRY

      44-616.   Business operations; limitation orcessation, hearings;changing conditions.It shall be unlawful for any person, firm, or corporation engaged in theoperation of any such industry, employment, utility, or common carrierwillfully to limit or cease operations for the purpose of limitingproduction or transportation or to affect prices, for the purpose ofavoiding any of the provisions of this act, except that any person, firm orcorporation so engaged may apply to the secretary oflabor for authority tolimit or cease operations, stating the reasons thereof thesecretary shall hear suchapplication promptly in accordance with the provisions of the Kansasadministrative procedure act, and if such application is found to be ingood faith and meritorious, thesecretary shall grant authority to limit orcease operations.

      In all such industries, employments, utilities or common carriers inwhich operation may be ordinarily affected by changes in season, marketconditions, or other reasons or causes inherent in the nature of thebusiness, the secretary may, upon application and after notice to allinterested parties, and investigation, as herein provided, make ordersfixing rules, regulations and practices to govern the operation of suchindustries, employments, utilities or common carriers for the purpose ofsecuring the best service to the public consistent with the rights ofemployers and employees engaged in the operation of such industries,employments, utilities or common carriers.
