Chapter 45.--PUBLIC RECORDS, DOCUMENTS AND INFORMATION
Article 4.--PUBLIC RECORDS PRESERVATION

      45-405.   State archives; transfer of records thereto; discard ordisposition of certain materials.(a) The state historical society shall serve as the official state archivesand shall assist state and local agencies in the preservation of governmentrecords with enduring value.

      (b)   Any state or local agency may transfer to the state archives anynoncurrent government records accepted by the state archivist and all stateagencies shall transfer to the state archives any noncurrent government recordswhen directed to do so by the state records board. With the approval of thestate archivist, noncurrent legislative and judicial records also may bedeposited in the state archives for preservation.

      (c)   The secretary of state shall not be prevented by any statute fromdepositing in the state archives any noncurrent government records accepted bythe state archivist.

      (d)   The provisions of this act shall not prohibit discarding or otherwisedisposing of extraneous, worthless or duplicate material found in governmentrecords when processed by the state archives staff. Any records placedin the state archives may be disposed of in any manner approved by the boardand the state archivist upon a determination that such records no longerhave enduring value.
