Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 2.--KANSAS ARMY AND AIR NATIONAL GUARD

      48-267.   Same; compensation; monthly benefit; computation.Any member, who is entitled to benefits under this act for any wound,injury, disease or illness, and who incurs a permanent disability therefromshall receive compensation as provided in this section. Entitlement tocompensation under this section shall commence at the conclusion of theperiod specified in K.S.A. 48-266 and continue so long assuch permanent disability exists. The monthly benefit under this sectionfor total or one hundred percent (100%) disability shall be one hundredtwenty dollars ($120) plus twelve and one-half percent (12 1/2%) of themonthly basic pay of the grade or rank held by the member at the timeentitlement under this act accrued. The monthly benefit under this sectionfor less than one hundred percent (100%) disability shall be a percent ofthe amount payable for total disability that is equal to the percent ofdisability that the member is sustaining. Entitlement under this sectionand the amount thereof shall be determined by the military disabilityboard. The board shall annually review each award under this section anddetermine whether it shall continue unchanged, be reduced, be increased orbe terminated.
