49-402c. Property and records transferred; resolution of conflicts by governor.(a) The Kansas department of health and environment shallsucceed to all property, property rights and records which were used for orpertain to the performance of the powers, duties and functions transferredpursuant to this act. Any conflict as to the proper disposition ofproperty or records arising under this section, and resulting from thetransfer, attachment or abolition of any state agency, board or office, orall or part of the powers, duties and functions thereof, shall bedetermined by the governor, whose decision shall be final.
(b) When any conflict arises as to the disposition of any power, duty orfunction or the unexpended balance of any appropriation as a result of anyabolition, transfer, attachment or change made by or under authority ofthis act, such conflict shall be resolved by the governor, whose decision shall be final.
