      49-511.   Relocation assistance for Treece communityin Cherokee county; definitions.As used in this act:

      (a)   "Affected community" means a community, located in Cherokee county andwithin the boundaries ofasuperfund site, which the secretary of health and environment determines haslost a substantial portionof the infrastructurenecessary for individuals to live within the community due to governmentfinanced programs ofrelocation of individuals, businesses and nonprofit organizations within suchsuperfund site."Affected community" includes any area surrounding such community whereresidents of thearea have lost essential services due to the community's loss ofinfrastructure.

      (b)   "Infrastructure" means basic facilities, services and installationsneeded for thefunctioning of a community, including, but not limited to, water service, fireprotection, lawenforcement services and retail establishments which sell groceries, toiletriesand other basicnecessities.

      (c)   "Person" means an individual or other legal entity.

      (d)   "Superfund site" means property which is listed on the nationalpriorities list ofsuperfund sites established under the comprehensive environmental response,compensation, andliability act (CERCLA), 42 U.S.C.A. 9601 et seq., as amended October 17, 1986.

      (e)   "Trust" means the trust created byK.S.A. 2009 Supp.49-512, andamendments thereto.
