Article 2.--MUSICAL AND DRAMATIC-MUSICAL COMPOSITIONS

      57-221.   Definitions.As used in this section:

      (a)   "Copyright owner" means the owner of a copyright of a nondramaticmusical work, other than a motion picture or other audio visual work,recognizedand enforceable under the copyright laws of the United States pursuant to title17 of the United States Code.

      (b)   "Performing rights society" means an association or corporation thatlicenses the public performance of nondramatic musical works on behalf ofcopyright owners, such as the American society of composers, authors andpublishers (ASCAP), broadcast music, inc. (BMI), and SESAC, inc.

      (c)   "Proprietor" means the owner of a retail establishment, restaurant,hotel, bar, tavern, sports or entertainment facility; a not-for-profitorganization; or any other similar place of business or professional officelocated in this state in which the public may assemble and in which nondramaticmusical works may be performed, broadcast or otherwise transmitted.

      (d)   "Royalty" or "royalties" means the license fees payable by a proprietorto aperforming rights society for the public performance of nondramatic musicalworks.
