Article 22.--PROBATE PROCEDURE

      59-2251.   Decree of descent.Upon the filing of a petition for determination ofdescent, the court shall fix the time and placefor the hearing on the petition. Notice ofany such hearing upon which title to real estate is to be assigned shallbe given pursuant toK.S.A. 59-2209 and amendments thereto. In all other cases, notice shallbe given or waived as provided in K.S.A. 59-2208 and amendments thereto.Upon proof of the petition, thecourt shall allow itand enter the court's decree assigning the property to the persons entitledthereto at the time of the decedent's death pursuant to the law ofintestate succession in effect on the date of thedecedent's death or a valid settlement agreement. For decedents dying beforeJuly 1, 1998, unless the death of the decedent hasoccurred more than 10 years prior to the decree of descent, no decreeshall be entered untilafter the determination and payment of inheritance taxes.
