Chapter 59.--PROBATE CODE Article 6a.--ELECTIVE SHARE OF SURVIVING SPOUSE

      59-6a215.   Homestead or homestead allowance.A surviving spouse is entitled to thehomestead, orin lieu thereof the surviving spouse may elect to receive a homesteadallowance of $50,000. The homestead or homesteadallowance is exempt from and haspriority over alldemands against the estate. The homestead or homestead allowance is inaddition to any sharepassing to the surviving spouse by way ofelective share.
