Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,249.   Umbilical cord banks; regulation ofoperations; rules and regulations; education and training in collection andmaintenance procedures; duties and functions of department of health andenvironment, Kansas bioscience authority.(a) Thesecretary of healthandenvironment shall adopt rules and regulations regarding the operation ofumbilical cordbanks in Kansas,including compliance with standards set by the federal government, andstandard collecting method guidelines to ensure effective and efficientinterfacing between healthcare providers and private industry umbilical cord banks with informed consentfrom the parents asstipulated by federal guidelines for research.

      (b)   Each umbilical cord bank in Kansas may accept and maintain umbilicalcord, umbilicalcord blood, amniotic fluid and placenta donations for research or treatment ofdisease, other than anysuch donations reserved for use by the donor or the donor's family, at nocharge or other cost to anydonor.

      (c)   Subject to the provisions of appropriation acts, the department of healthandenvironment shall develop and make available education and training in thebasic procedures andother requirements for collecting and maintaining umbilical cord, umbilicalcord blood, amnioticfluid and placenta donations to all health care providers, other medicalpersonnel and clinical staffwho are involved in obstetrical care in Kansas.

      (d)   Each umbilical cord bank in Kansas may enter into agreements withinstitutionsconducting research for the purposes of providing umbilical cords, umbilicalcord blood, amnioticfluid or placentas from the umbilical cord bank for purposes of research.

      (e)   Each entity operating an umbilical cord bank in Kansas that ismaintaining umbilicalcords, umbilical cord blood, amniotic fluid and placentas for purposes ofresearch, shall monitor thesupply of and demand for umbilical cords, umbilical cord blood, amniotic fluidand placentas inKansas for purposes of research. If the entity operating such umbilical cordbank determines that thedemand for umbilical cords, umbilical cord blood, amniotic fluid or placentasto be provided by suchumbilical cord bank is greater than the supply available in such umbilical cordbank therefor, theentity operating such umbilical cord bank may notify Kansas health careproviders of the need foradditional umbilical cords, umbilical cord blood, amniotic fluid or placentas.

      (f)   The Kansas bioscience authority may coordinate the use of umbilicalcords, umbilicalcord blood, amniotic fluid or placentas in umbilical cord banks in Kansas forthe purposes ofresearchthat complies withthe high standards of the Kansas bioscience authority.

      (g)   The department of health and environment and the Kansas bioscienceauthority shallcollaborate and jointly encourage or otherwise facilitate the recruitment ofentities to establishumbilical cord banksin Kansas and partnerships between umbilical cord banks in Kansas andresearchers or organizationsin Kansas, or in other regions of the United States of America or othercountries.
