Article 11.--REGULATION OF NURSING

      65-1162.   Unlawful acts.(a) Except asotherwise provided in K.S.A. 65-1151 to 65-1163, inclusive, and amendmentsthereto any licensed professional nurse or licensed practical nurse whoengages in theadministration of general or regional anesthesia without being authorizedby the board to practice as a registered nurse anesthetist is guilty of a classA misdemeanor.

      (b)   Any person, corporation,association or other entity, except as otherwise provided inK.S.A. 65-1151 to 65-1163, inclusive, and amendments thereto whoengages in any of the following activities is guilty of a misdemeanor:

      (1)   Employing or offering to employ any person as a registered nurseanesthetist with knowledge that such person is not authorized by the boardto practice as a registered nurse anesthetist;

      (2)   fraudulently seeking, obtaining or furnishingdocuments indicating that a person is authorized by the board to practiceas a registered nurse anesthetist when such person is not so authorized, oraiding and abetting such activities;

      (3)   using in connection with one's name the title registered nurseanesthetist, the abbreviation R.N.A., or any other designationtending to imply that such person is authorized by the board to practice as aregistered nurse anesthetist when such person is not authorized by theboard to practice as aregistered nurse anesthetist; or

      (4)   violation of the Kansas nurse practice act or rules and regulationsadopted pursuant thereto.

      (c)   Any person who violates subsection (b) of this section is guilty of aclass Bmisdemeanor exceptthat uponconviction of a second or subsequent violation of this section,the person is guilty of a class A misdemeanor.
