Article 14.--REGULATION OF DENTISTS AND DENTAL HYGIENISTS

      65-1449.   Revocation or suspension of license, statement of charges;emergency adjudication; temporary suspension or limitation.(a) Except as provided by subsection (b), no action to revoke or suspenda license shall be taken until thelicensee has been furnished a statement in writing of the chargesagainst the licensee, together with a notice of the time and place of thehearing. The statement of charges and notice shall be served upon thelicensee in accordance with the provisions of the Kansasadministrative procedure act.

      (b)   If the board determines thatthere is probable cause to revoke or suspend the license of a dentist ordental hygienist for any reason that exists pursuant to K.S.A. 65-1436, andamendments thereto, and if the licensee's continued practice would constitutean imminent danger to public health and safety, the board may initiate administrativeproceedings for an emergency adjudication under the provisions of the Kansasadministrative procedure act.

      In no case shall a temporary suspension or temporary limitation of alicense under this section be in effect for more than90 days. At the end of such period of time, the licenseeshall be reinstated to full licensure unless the board has revoked orsuspended the license of the licensee after notice andhearing, provided in accordance with the provisions of theKansas administrative procedure act.
