Article 17.--REGULATION OF EMBALMERS AND FUNERAL DIRECTORS; FUNERAL ESTABLISHMENTS

      65-1718.   Disposition of moneys; mortuary arts fee fund.(a) The state board of mortuary arts shall remit allmoneys received by or for it from fees, charges or penalties to the statetreasurer in accordance with the provisions ofK.S.A. 75-4215, and amendments thereto. Upon receipt ofeach suchremittance, the statetreasurer shall deposit the entire amount in the state treasury.Twenty percent of each such deposit shall be credited to thestate general fund and the balance shall be credited to the mortuary artsfee fund. All expenditures from such fund shallbe made in accordance with appropriation acts upon warrants of the directorof accounts and reports issued pursuant to vouchers approved by thesecretary of the state board of mortuary arts or by aperson or persons designated by the secretary.

      (b)   On July 1, 1985, the director of accounts and reports shalltransfer all moneys in the embalming board fee fund to the mortuary artsfee fund. On July 1, 1985, all liabilities of the embalming board fee fundare hereby imposed upon the mortuary arts fee fund, and the embalming boardfee fund is hereby abolished.

      (c)   Whenever the embalming board fee fund, or words of like effect, isreferred to or designated by a statute, contract or other document, suchreference or designation shall be deemed to apply to the mortuary arts feefund.
