Article 17.--REGULATION OF EMBALMERS AND FUNERAL DIRECTORS; FUNERAL ESTABLISHMENTS

      65-1728.   Eye enucleation; embalmers and otherpersons; certificate of competence; liability.For the purpose of removing an eye or part thereof, any embalmer licensedin accordance with the provisions of article 17 ofchapter 65 of the Kansas Statutes Annotated, and acts amendatorythereof, a licensed nurse,technician employed by a nationally certified eye bank, licensed optometrist,attendant as defined under K.S.A. 65-6112 and amendments thereto orphysician assistant,who has completed a course in eye enucleation at a schoolcertified by the department of ophthalmology, college of medicine of theuniversity of Kansas school of medicine, and holds a valid certificate ofcompetence from such certified school, or a person licensed to practicemedicine and surgery is hereby authorized to enucleate eyes from anybody when the gift of such eye has been made in accordance with theterms of the revised uniform anatomical gift act(K.S.A. 2009 Supp.65-3220 through 65-3244,and amendmentsthereto). Persons certified in accordance with thissection and persons licensed to practice medicine andsurgery who perform the enucleation of eyes in accordance with theprovisions ofK.S.A. 2009 Supp.65-3220 through 65-3244, andamendments thereto, shall incur no liability, civilor criminal, for his acts in performance of enucleation of eyes.
