Article 24.--UNIFORM VITAL STATISTICS ACT

      65-2418.   Fees for copies and searches; disposition;exemptions; copies, abstractsor data furnished to national office of vitalstatistics.(a) (1) Thesecretary shall fixand charge by rules and regulations the fees to be paidfor certified copies orabstracts of certificates orfor search of the files for birth, death, fetal death, marriage ordivorce records when no certified copy or abstract ismade.Except as otherwise provided in this section, the secretary shall remit allmoneys received by or for the secretary from fees, charges or penalties, underthe uniform vital statistics act and amendmentsthereto, to thestate treasurer in accordance with the provisions of K.S.A. 75-4215, andamendments thereto. Upon receipt of each such remittance, the state treasurershall deposit the entire amount in the state treasury to the credit of thecivil registration and health statistics fee fund created byK.S.A. 2009 Supp.65-2418e, andamendments thereto.

      (2)   The secretary shall not charge any fee for acertified copy of a certificate or abstract or for a search of the filesor records if thecertificate, abstract or search is requested by a person who exhibitscorrespondence fromthe United States department of veteransaffairs or the Kansas commission on veterans'affairs which indicates that the person is applying for benefits from theUnited States department of veteransaffairs and that such person needs the requestedinformation to obtain such benefits, except that, for a second or subsequentcertified copy of a certificate, abstract or search of the filesrequested by theperson,the usual fee shall be charged.The secretary may provide by rules and regulations forexemptionsfrom such fees.

      (3)   Upon receipt of any such remittance of a fee for acertified copy of a birth certificateor abstract,$3 of each such fee for the first copy of a birth certificate orabstract and $1 of eachsuch fee for each additional copy of the same birth certificate orabstract requested atthe same time shall be remitted to the state treasurer inaccordance withthe provisions of K.S.A. 75-4215, and amendments thereto. Upon receipt of eachsuch remittance, the state treasurer shall deposittheentire amountin the state treasury to the credit of thepermanent families account of thefamily and children investment fund created by K.S.A. 38-1808, andamendments thereto.The balance of the money received for a fee for a certified copy of a birthcertificate orabstract shall be remitted to the state treasurer in accordance with theprovisions of K.S.A. 75-4215, and amendments thereto. Upon receipt of each suchremittance, the state treasurer shall deposit the entire amount in the statetreasury to the credit of the civil registration and health statistics fee fundcreated under this act.

      (4)   Upon receipt of any such remittance of a fee for a certified copyof a deathcertificate or abstract, $4 of each such fee for the firstcertified copy of adeath certificate or abstract and$2 of each such fee for each additional copy of the same deathcertificateor abstract requested at the same time shall be remitted to the statetreasurerinaccordance with the provisions of K.S.A. 75-4215, and amendments thereto. Uponreceipt of each such remittance, the state treasurershalldeposit the entire amount in thestatetreasury to the credit of the district coronersfund created by K.S.A.22a-245, and amendments thereto.Thebalance of themoney received for a fee for a certified copy of a deathcertificate orabstract shall beremitted to the statetreasurer in accordance with the provisions of K.S.A. 75-4215,andamendments thereto. Upon receipt of each such remittance, the statetreasurer shall deposit the entire amountin the state treasury to the credit of the civilregistration and health statistics fee fund created byK.S.A. 2009 Supp.65-2418e, andamendments thereto.

      (b)   Subject to K.S.A. 65-2415, and amendments thereto, the national officeof vital statistics may be furnished copies or data it requires for nationalstatistics. The state shall be reimbursed for the cost of furnishing the data.The data shall not be used for other than statistical purposes by the nationaloffice of vital statistics unless so authorized by the state registrar of vitalstatistics.
