      65-2914.   Fraud or deception in application forlicense; scope of authorized treatment.(a) No person shall employ fraud or deception in applying for or securing alicense as a physical therapist.

      (b)   A person licensed under this act as a physicaltherapist shall nottreat ailments or other health conditions of human beings other than byphysical therapy unless duly licensed or registered to provide suchtreatment under the laws of this state.

      (c)   A person certified under this act as a physical therapist assistantshall not treat ailments or other health conditions of human beings exceptunder the direction of a physical therapist dulylicensed under this act.The word "direction" as used in this subsection (c) shall mean that thephysical therapist shall see all patients initially and evaluate themperiodically except in those cases in a hospital setting when thephysical therapist is not immediately available, the physical therapistassistant may initiate patient care after telephone contact with thephysical therapist for documented instruction. The physical therapist mustthen evaluate the patient and establish a plan of treatment as soon as possiblewith a minimum weekly review.

      (d)   Any person violating the provisions of this section shall be guiltyof a class B misdemeanor.
