65-3011. Enforcement; procedure.(a) If the secretary or the director of the division of environment findsthat any personhas violated any provision of any approval, permit or compliance plan or anyprovision of this act or any rule and regulation promulgated under this act,the secretary may issue an order finding such person in violation of the actand directing the person to take such action as necessary to correct theviolation. Any order issued shall specify the length of time after receipt ofthe order during which the person must correct the violations.
(b) Any person to whom an order is issued pursuant to subsection (a) mayrequest a hearing within 15 days after service of the order. Hearings beforethesecretary shall be conducted in accordance with the Kansas administrativeprocedure act.
