Article 32.--REVISED UNIFORM ANATOMICAL GIFT ACT

      65-3227.   Preclusive effect of anatomical gift,amendment, or revocation.(a) Except as otherwise provided in subsection (g) andsubject to subsection (f), in theabsence of an express, contrary indication by the donor, a person other thanthe donor is barredfrom making, amending, or revoking an anatomical gift of a donor's body or partif the donormade an anatomical gift of the donor's body or part underK.S.A. 2009 Supp.65-3224, andamendments thereto, or anamendment to ananatomical gift of the donor's body or part underK.S.A. 2009 Supp.65-3225,and amendmentsthereto.

      (b)   A donor's revocation of an anatomical gift of the donor's body or partunderK.S.A. 2009 Supp.65-3225, and amendments thereto, is not a refusal and doesnot bar anotherperson specified inK.S.A. 2009 Supp.65-3223 or 65-3228, and amendmentsthereto, from makingan anatomical gift of the donor's body or part underK.S.A. 2009 Supp.65-3224or 65-3229, andamendments thereto.

      (c)   If a person other than the donor makes an unrevoked anatomical gift ofthe donor'sbody or part underK.S.A. 2009 Supp.65-3224, and amendments thereto, or anamendment to ananatomical gift of thedonor's body or partunderK.S.A. 2009 Supp.65-3225, and amendments thereto, another person may notmake, amend, orrevoke the gift of thedonor's body orpart underK.S.A. 2009 Supp.65-3229, and amendments thereto.

      (d)   A revocation of an anatomical gift of a donor's body or part underK.S.A. 2009 Supp.65-3225, and amendments thereto, by aperson other than the donor does not bar another person from making ananatomical gift of thebody or part under K.S.A. 65-3224 or 65-3229, and amendments thereto.

      (e)   In the absence of an express, contrary indication by the donor or otherpersonauthorized to make an anatomical gift underK.S.A. 2009 Supp.65-3223, andamendments thereto,an anatomical gift of apart is neither arefusal to give another part nor a limitation on the making of an anatomicalgift of another part ata later time by the donor or another person.

      (f)   In the absence of an express, contrary indication by the donor or otherpersonauthorized to make an anatomical gift underK.S.A. 2009 Supp.65-3223, andamendments thereto,an anatomical gift of apart for one or more of the purposes set forth inK.S.A. 2009 Supp.65-3223,and amendmentsthereto, is not a limitationon the making of an anatomical giftof the part for any of the other purposes by the donor or any other personunderK.S.A. 2009 Supp.65-3224 or 65-3229, and amendments thereto.

      (g)   If a donor who is an unemancipated minor dies, a parent of the donor whoisreasonably available may revoke or amend an anatomical gift of the donor's bodyor part.

      (h)   If an unemancipated minor who signed a refusal dies, a parent of theminor who isreasonably available may revoke the minor's refusal.
