Article 40.--ALCOHOLISM AND INTOXICATION TREATMENT

      65-4024.   Acceptance for treatment; rules andregulations; standards.The secretary shall adopt rules and regulationsfor acceptance of persons into a licensed treatmentfacility. Inadopting rules and regulations the secretary shall be guided bythefollowing:

      (1)   If possible a person shall be treated on avoluntary rather than aninvoluntary basis.

      (2)   A person shall be assessed to determine the appropriatenessof the treatment and shall receive treatment in the least restrictivetreatment environment possible.

      (3)   A person shall not be denied treatment solely becausesuch person has withdrawn from treatment against medical advice on a prioroccasion or because such person has relapsed after earliertreatment.

      (4)   An individualized treatment plan shall be prepared and maintained ona current basis for each person.

      (5)   Provisions shall be made for a continuum of coordinated treatmentservices, so a person who leaves a facility or a form of treatmentwill have available other appropriate treatment.
