65-5731. Rights preserved in legal actions andproceedings.No suit, action, or other proceeding, judicial oradministrative, lawfully commenced, or which could have been commenced, by oragainst any stateagency, or program mentioned in this order, or by or against any officer of thestate in such officer's official capacity or in relation to the discharge ofsuch officer's official duties, shall abate by reason of the governmentalreorganization effected under the provisions of this order. The court mayallow any such suit, action, or other proceeding to be maintained by or againstthe successor of any such state agency or any officer affected.
