      65-652.   Same; enforcement; destruction or sale; disposition of proceeds of sale.Any poison such as described in K.S.A. 65-651 which is not distinctlycolored as required by this act when offered or exposed for sale, orsold, or located upon the premises of any establishment handling foods,shall be liable to be proceeded against in any court of competentjurisdiction. If such poison is condemned by said court as not beingdistinctly colored, it shall be disposed of by destruction or sale, asthe court may direct; and if sold, the same shall be distinctly coloredin accordance with the provisions of this act, and the proceeds, lessthe actual cost and charges, shall be paid over to the clerk of thedistrict court in the county in which such sale is had, and the clerk ofsuch court shall pay the same to the county treasurer. Such condemnationproceedings shall conform as near as may be to proceedings inconfiscation of intoxicating liquors.
