Chapter 65.--PUBLIC HEALTH
Article 7.--MILK, CREAM AND DAIRY PRODUCTS

      65-789.   Unlawful acts.It shall be unlawful for any person to:

      (a)   Engage in any business or activity which requires a license or permitunder this actwithout having a license or permit;

      (b)   sell, offer or expose for sale:

      (1)   Any milk, milk products or dairy products which do notconform to the definition andstandards of identity established under this act; or

      (2)   any milk, milk products or dairy products which are adulterated ormisbranded.

      (c)   adulterate or misbrand any milk, milk products or dairyproducts;

      (d)   sell, offer for sale or have in such person's possession with the intentto sell at retail to the finalconsumer any milk or milk product which has not been inspected and designatedgrade Apasteurized in accordance with the provisions of this act and anyrules and regulations adopted thereunder, except that on-farm retail sales ofmilk or milkproducts shall be exempt from the provisionsof this act unless stated otherwise; or

      (e)   violate any provision of this act or any rules or regulations promulgatedthereunder.
