Article 74.--PRIMARY CARE SAFETY NET CLINIC CAPITAL LOAN GUARANTEES

      65-7402.   Definitions.As used in the primary care safety net clinic capital loan guarantee act:

      (a)   "Act" means the primary care safety net clinic capital loan guaranteeact;

      (b)   "community health center" means an entity that receives funding undersection 330 ofthe federal health center consolidation act of 1996 and meets all of therequirements of 42 USCsection 254b, relating to serving a population that is medically underserved,or a special medicallyunderserved population comprised of migratory and seasonal agriculturalworkers, the homeless, andresidents of public housing, by providing, either through staff and supportingresources of the centeror through contracts or cooperative arrangements, all required primary healthservices as defined by42 USC section 254b;

      (c)   "federally-qualified health center look-alike" means an entity which hasbeen determined by the federal health resources and services administration tomeet the definition of a federally qualified health center as defined bysection 1905(l)(2)(B) of the federal social security act, but which does notreceive funding under section 330 of the federal health center consolidationact of 1996;

      (d)   "financial institution" means any bank, trust company, savings bank,credit union or savings and loan association or any other financial institutionregulated by the state of Kansas, any agency of the United States or otherstate with an office in Kansas which is approved by the secretary for thepurposes of this act;

      (e)   "provider-based indigent care clinic" means a clinic located in amedicare-certified hospital, nursing facility or home health agency licensedunder K.S.A. 65-425 et seq., 39-923 et seq. or 65-5101 et seq., and amendmentsthereto, designed to provide care to the medically indigent under the medicaldirections of a qualified person licensed to practice medicine and surgery andlicensed by the Kansas board of healing arts; and which has a contractualagreement in effect with the secretary of health and environment under K.S.A.75-6120, and amendments thereto, to provide health care services to medicallyindigent persons.

      (f)   "indigent health care clinic" means an outpatient medical care clinicoperated on a not-for-profit basis which has a contractual agreement in effectwith the secretary of health and environment under K.S.A. 75-6120 andamendments thereto to provide health care services to medically indigentpersons;

      (g)   "loan transaction" means a transaction with a financial institution orthe Kansasdevelopment finance authority to provide capital financing for the renovation,construction, acquisition, modernization, leasehold improvement or equipping ofa primary care safety net clinic;

      (h)   "medically indigent person" means a person who lacks resources to pay formedically necessary health care services and who meets the eligibility criteriafor qualification as a medically indigent person established by the secretaryof health and environment under K.S.A. 75-6120 and amendments thereto;

      (i)   "primary care safety net clinic" means a community health center, afederally-qualified health center look-alike, an indigent health care clinic ora provider-based indigent care clinic; and

      (j)   "secretary" means the secretary of health and environment.
